These Terms & Conditions (the "Terms") govern your access to and use of the website and related online services operated by KollegeApps (collectively, the "Services" or "Website"). By accessing or using any part of the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.

The Services are intended for users who are 13 years of age or older and who are legally able to enter a binding agreement. By using the Services, you represent that you meet these requirements.

KollegeApps is not sponsored by, affiliated with, or endorsed by the Common Application or by any university, college, or other educational institution mentioned on the Website. References to schools or programs are for informational purposes only.

We may revise these Terms from time to time. Updates take effect when posted on this page unless we state otherwise. Your continued use of the Services after revised Terms are posted constitutes acceptance of the changes. You should review these Terms periodically.

We may modify, suspend, or discontinue any part of the Services at any time. We do not guarantee that the Services will always be available or uninterrupted.

If you create an account, you must keep your credentials confidential, use only your own account, and notify us promptly of unauthorized access or suspected misuse. You are responsible for activity under your account to the extent permitted by law. Information you provide must be accurate and complete.

We may disable, suspend, or terminate accounts or access if we believe these Terms have been violated or if needed to protect the Services, users, or our business.

By creating an account or using the Services, you consent to receive notices and other communications from us electronically, including by email or through the Website. Keep a valid email address on file so you can receive important messages about your account, purchases, and uploads.

Your use of the Services is subject to our Privacy Policy. Internet transmissions are never completely secure; while we take reasonable steps to protect information, we cannot guarantee absolute security of data transmitted to or stored by us or third parties. Third-party tools integrated with the Services are governed by their own terms and privacy practices.

The Website and its content, features, and branding—including text, graphics, software, and design—are owned by KollegeApps or its licensors and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Services for your personal, non-commercial use, subject to these Terms. You may not copy, scrape, redistribute, sell, or otherwise exploit Website content except as expressly allowed by these Terms or applicable law.

University names and logos appearing on the Website are trademarks of their respective owners and are used for identification only.

Content on the Services—including admitted student profiles, essays, activities, and outcomes—is provided for general informational and educational purposes. We do not guarantee completeness, accuracy, or suitability of any content. Nothing on the Services constitutes admissions, legal, financial, or other professional advice, and use of the Services does not guarantee admission to any school or any particular result. Reliance on Website content is at your own risk.

KollegeApps may offer paid credit packs or other paid products. You agree to provide accurate billing information and authorize our payment processors to charge the applicable fees. We use third-party processors (such as Stripe) to handle payments; we do not store full payment card numbers.

Unless required by law or expressly stated otherwise at purchase, fees are generally non-refundable. Credits are applied to your account after successful payment and may be used to unlock profiles as described on the Website. We may suspend or terminate access if we reasonably suspect fraudulent or unauthorized payment activity.

Approved profiles may be previewed in limited form and unlocked for fuller access using credits or other purchase methods we offer. Unless we state otherwise, unlocked access is personal to your account, non-transferable, and subject to anti-abuse limits. Do not redistribute unlocked profile materials outside the Services.

Credit balances, unlock entitlements, and package details may change as we update the product. We may correct obvious errors in credit grants or unlocks.

Your submissions

If you upload application materials or related content ("Contributor Content"), you represent that you have the rights to submit it, that it is accurate to the best of your knowledge, and that it does not violate law or third-party rights. You are responsible for removing or avoiding sensitive personal information you do not wish to share.

By submitting Contributor Content, you grant KollegeApps a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for formatting, moderation, or anonymization), display, and otherwise use that content to operate, improve, promote, and provide the Services—including making approved profiles available to other users under our access model.

Review and payouts

Uploads may be reviewed before publication. We may approve, reject, edit, anonymize, or remove Contributor Content at our discretion. Any compensation, rewards, or payouts described on the Website are subject to eligibility, verification, fraud controls, and the program terms in effect at the time. We may update or discontinue contributor programs.

You agree not to:

• Use the Services unlawfully, fraudulently, or in a way that harms others
• Infringe intellectual property, privacy, or other rights
• Upload unlawful, defamatory, or otherwise objectionable material
• Scrape, harvest, or systematically copy profiles or other content without our written permission
• Attempt unauthorized access to systems, accounts, or data
• Interfere with the security or proper working of the Services
• Impersonate another person or misrepresent your affiliation or admissions outcomes
• Resell, publicly redistribute, or commercially exploit unlocked profile materials

THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOLLEGEAPPS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

These Terms are governed by the laws applicable in the jurisdiction where KollegeApps primarily operates its business, without regard to conflict-of-law principles, except where mandatory consumer protections in your place of residence require otherwise. Courts in that jurisdiction will have exclusive jurisdiction over disputes, subject to those mandatory protections.
